Overcoming Obstacles in an Auto Case Trial – How My Paralegal Support Led to a Successful Settlement
When an attorney is preparing for trial, especially in complex personal injury cases such as auto accidents, the importance of detailed preparation cannot be overstated. In a recent case, I had the opportunity to assist a law firm with a complex auto accident case that was on the verge of trial. The case involved significant challenges, including an uncooperative opposing counsel, tight deadlines, and incomplete trial documents. Despite these hurdles, my efforts played a critical role in helping the attorney prepare thoroughly, resulting in a settlement just days before trial.
Case Background:
The case involved an auto accident where the plaintiff suffered serious injuries. With no resolution in sight, the case was set to proceed to trial in California.
Challenges Faced:
Opposing Counsel's Lack of Cooperation: Unresponsive opposing counsel and failing to cooperate with joint trial documents.
Trial Preparation: Key tasks needed to be completed in a limited time frame, including motions in limine, exhibit list, jury instructions and preparation of trial notebooks.
Solution:
Despite the lack of cooperation from opposing counsel, I took proactive steps to ensure that all trial documents were in order and ready for submission to the court:
Motions in Limine: These motions were prepared for filing with the court, ensuring that the attorney could proceed with confidence.
Jury Instructions: I worked closely with the attorney to propose a set of comprehensive and well-crafted jury instructions.
Exhibits List & Collection: I coordinated the collection of all exhibits (200+), ensuring that they were properly organized, labeled, and in compliance with court requirements.
Results:
Despite the obstacles, the attorney was able to move forward with the trial preparation and meet all deadlines set by the court.
As the trial date neared, the opposing counsel, faced with the well-prepared motions and organized documents, began to realize the strength of the case. Just days before the trial was set to begin, the defendant’s insurance company agreed to a settlement that was much higher than their previous offers, avoiding the need for a lengthy and costly trial.
